Why do you need a temporary work and residence permit in Montenegro?

The Law on Foreigners regulates the conditions for entry, movement, and stay of foreigners on the territory of Montenegro. Entry into Montenegro implies crossing the state border, the border crossing at which border control is performing. In terms of this law, detention of a foreigner in the airport’s transit area and anchorage of the port or port is not considered an entry into Montenegro.

The Law on Foreigners stipulates that the stay of foreigners in Montenegro is:

  • stay up to 90 days
  • temporary residence
  • permanent residence

 

Temporary residence and work permit are proof of legal movement, residence, and work for a foreign citizen in the territory of Montenegro. It is mandatory to have it if the foreigner is employed and resides in the region of Montenegro.

Temporary residence and work permits are issued in the form of a plastic card that you show to the authorized entities per request, e.g., at border crossings or if you have committed a traffic violation. To drive a car in Montenegro with local license plates, you are required to have a registered temporary residence.

 

A work and residence permit in Montenegro is used for:

  • employment of a foreigner;
  • seasonal employment of a foreigner;
  • the work of the seconded worker
  • providing contracted services;

The duration of the residence and work permit is limited

Depending on the type of license, they have different validity periods. Thus, a temporary residence and work permit for employment are valid for up to one year. A temporary residence and work permit for seasonal jobs are valid for up to six months for one year. There are also permits for seconded workers for a maximum of 3 months during one calendar year.

Required documentation for submitting a permit application

  • proof of means of subsistence;
  • proof of accommodation provided;
  • proof of health insurance;
  • a photocopy of a valid travel document;
  • evidence that in the country of origin he has not been sentenced to unconditional imprisonment for a term exceeding six months for a criminal offense for which he is prosecuted ex officio or the legal consequences of the conviction have ceased;
  • a written offer of the employer for the employment of a foreigner for a specified job, which contains – all the essential elements of the employment contract (not submitted by the entrepreneur and executive director if the sole owner or owner is more than 51% of the capital);
  • proof of the acquired level of education and qualification (recognition of diplomas issued in the Republic of Serbia before January 25, 2008, as well as from the former republics of S.F.R.J. until the day when they became independent states,1992/1993) is not required;
  • proof of medical fitness (medical certificate issued by the competent health institution in Montenegro);
  • evidence of registration of a legal or natural person with a registered office in Montenegro (excerpt from Central Register of Business Entities).

Required documentation for submitting a request for temporary residence based on ownership of a real estate

A foreigner in Montenegro may exercise the right to reside based on ownership of real estate (apartment, house, office space)

  • proof of that a registration has been made in the Tourist Organization
  • copy of a valid travel document (passport)
  • real estate folio in the land register, not older than six months
  • proof of health insurance
  • proof of means of subsistence
  • proof that in the country of origin he/she has not been sentenced to unconditional imprisonment for a term exceeding six months for a criminal offense for which he is prosecuted ex officio or the legal consequences of the conviction have ceased;
